Getting arrested or charged with a crime is both shocking and scary. If you or someone you know have been charged with a crime in Indiana, it will generally fall into one of three categories: an infraction; a misdemeanor; and/or a felony.
An infraction is a violation of an ordinance or statute like a speeding ticket or not wearing a seatbelt.
A misdemeanor is a crime that may be punished by no more than one year of incarceration.
A felony is the most serious crime and is punishable by more than one year of incarceration.
In Indiana the felonies are divided into 6 levels with 6 being the least serious as it is the lowest felony, and in some circumstances may be eligible for misdemeanor treatment. Some common level 6 felonies are:
- Possession of Methamphetamine
- Possession of a Controlled Substance
- Dealing in a Controlled Substance
- OWI with a Prior Conviction with 5 Years
- Neglect of a Dependent
This list is not by any means exhaustive. Under the Indiana criminal code, the possible sentence for Level 6 felony is between six months to 2 1/2 years incarceration,and the person may be fined not more than ten thousand dollars ($10,000).
